This article is based on the purpose of investigating and, certainly, ratifying the pertinence and even the progress raised in the brazilian procedural systematic due to the incorporation of the overruling technique, traditionally linked to the common law system and intended for the review of already consolidated judicial precedents. As this is a relatively recent and controversial issue, it is intended to demonstrate the compatibility between the overruling mechanism with the brazilian procedural model, based on the traditional normative rigidity, typical of the civil law system and, in the same way, the favorable effects of incorporation of that technique to achieve greater justice and legal certainty.
