Responsabilidade penal de governantes na pandemia de covid 19 ante o tribunal penal internacional1

This paper aims to analyze the possibility of imputing a crime against humanity to the International Criminal Court, due to the omission of Heads of State in combating the COVID 19 Pandemic, based on the rules of Public International Law. The adopted procedures are analyzed, the limitation of the matter that can be discussed, the individual's responsibility regardless of the position he / she occupies. It investigates the mandatory submission of States to the recommendations of the World Health Organization, and the action against them by the Brazilian Government encouraged by the President of the Republic who insists on ignoring them. The study was developed with theoretical legal methodology and deductive reasoning, with techniques of bibliographic and documentary research. It was concluded that the trial by the International Criminal Court would not be possible.
